dealing with different tax rules, reporting dates and exchange rates. For UK residents, you may need to report overseas income HMRC treats as taxable in the UK, even if you’ve already paid tax in the country where the income arose. Double Taxation Relief UK rules can help reduce the amount of UK tax payable where the same income is taxed overseas and in the UK. The relief available depends on factors such as your UK tax residence, the type of income, the foreign tax paid and the relevant tax treaty.

Finsoul Network UK helps individuals and businesses understand UK tax requirements connected with international income and cross-border activities. Understanding how foreign income is reported and how tax relief works can make Self Assessment easier and help you avoid claiming the wrong type of relief. The rules changed from 6 April 2025, so it is also important to consider the current Foreign Income and Gains regime when looking at overseas income.

What Is Double Taxation Relief in the UK?

Double taxation relief is designed to prevent the same income or gain from being taxed twice without appropriate relief. This can happen when the country where income arises taxes it at source while the UK also taxes the same income because the person is UK tax resident.

The UK can provide relief through a tax treaty, a foreign tax credit or certain unilateral provisions. The exact treatment depends on the countries involved, the type of income and the applicable tax rules. A foreign tax credit is generally limited to the lower of the qualifying foreign tax and the UK tax attributable to the same income or gain.

Term

Meaning

Double taxation relief

General term for relief that prevents or reduces tax being charged twice

Foreign tax credit

Credit for qualifying foreign tax against UK tax on the same income

Tax treaty

Agreement between two countries that sets out taxing rights and relief

Foreign income

Income arising outside the UK, such as overseas rent, interest or dividends

Self Assessment

UK tax return system used to report many types of foreign income

Do UK Residents Pay Tax on Overseas Income?

UK residents will normally need to pay UK tax on their foreign income and gains, although specific reliefs and exemptions can change the result. Foreign income can include overseas employment income, dividends, savings interest, pension income and rental income from property outside the UK. If foreign income is taxable in the UK and tax has also been paid overseas, you may be able to claim relief rather than paying tax twice on the same amount.

Why Your UK Tax Residence Matters

Your UK tax residence is one of the first things to check. The Statutory Residence Test is used to establish whether you are UK resident for tax purposes. If you are not UK resident, non-UK resident tax rules apply instead, and these generally focus on income arising in the UK. Since 6 April 2025, the UK’s foreign income rules have also changed following the introduction of the Foreign Income and Gains regime.

How Double Taxation Relief Works in the UK

The process can be easier to understand when broken down into six stages.

1. Identify the Overseas Income

Start by establishing exactly what income you received and where it arose. This could be overseas employment income, rental income, interest, dividends, pension income or another type of foreign income.

2. Check Your UK Tax Residence

Your residence status affects how your overseas income is treated in the UK. A person who is UK resident will normally have UK tax obligations on foreign income, subject to applicable reliefs.

3. Check the Relevant Tax Treaty

Look at the UK’s tax treaty with the country where the income arose. The treaty may determine which country has taxing rights or limit the amount of tax that can be charged.

4. Confirm the Foreign Tax Paid

Keep evidence showing the amount and type of foreign tax paid. Depending on the income, this may include a foreign tax statement, withholding certificate, tax assessment or other official record.

5. Calculate the Available Relief

The credit is not automatically equal to the full amount of foreign tax paid. It is generally restricted to the UK tax attributable to the same income or gain.

6. Report the Income Correctly

If the income needs to be reported through Self Assessment, include the overseas income and the relevant foreign tax details. The foreign pages of the return are used to record many types of foreign income and gains and claim applicable relief.

How Foreign Tax Credit Relief Is Calculated

A foreign tax credit can reduce the UK tax due on income that has already been subject to qualifying foreign tax. However, the credit is normally restricted to the lower of the qualifying foreign tax and the UK tax attributable to the same income.

Example 1: Foreign Tax Is Lower Than UK Tax

Suppose you receive £10,000 of overseas income and pay £1,500 of qualifying foreign tax. If the UK tax attributable to that same income is £2,000, a simplified calculation could result in a £1,500 credit.

The remaining UK tax on that income would therefore be £500.

Example 2: Foreign Tax Is Higher Than UK Tax

Now suppose the same £10,000 of income resulted in £3,000 of qualifying foreign tax, while the UK tax attributable to that income was £2,000.

The UK credit would generally be restricted to £2,000 rather than the full £3,000. The excess foreign tax does not automatically become an additional UK credit.

These examples are simplified. Actual calculations can depend on the type of income, tax rates, treaty provisions and your wider tax position.

What Is a Double Taxation Agreement?

A tax treaty is an agreement between two countries that sets out how certain types of income and gains should be taxed when they have a connection with both countries.

How Does a Tax Treaty Help?

A treaty may give one country exclusive taxing rights over particular income. In other cases, both countries may have taxing rights but the treaty can restrict the amount of tax charged or provide a method of relief. The result depends on the specific treaty and the type of income involved.

What If There Is No UK Tax Treaty?

The absence of a treaty does not necessarily mean that you will have no relief. UK rules can provide unilateral relief in qualifying circumstances. The foreign tax must meet the relevant conditions, and it generally needs to correspond to UK Income Tax or Capital Gains Tax.

Which Types of Overseas Income Can Qualify for Relief?

Different types of overseas income can have different UK and treaty treatment, so it is important to identify the nature of the income before claiming relief.

Overseas income

What to check

Possible relief consideration

Foreign salary

Where the work was performed and your residence

Treaty rules and foreign tax credit

Overseas property rent

Property location and foreign tax paid

UK reporting and possible credit

Foreign dividends

Dividend rules and withholding tax

Treaty limits and credit rules

Overseas interest

Source country and tax deducted

Foreign tax credit may apply

Foreign pension

Pension type and treaty provisions

Taxing rights may vary by treaty

How to Claim Double Taxation Relief Through Self Assessment

If you are a UK resident with foreign income that needs to be reported, you will usually need to include the relevant information in your Self Assessment return. The foreign section, SA106, is used to record many types of foreign income and gains and to claim a foreign tax credit where appropriate. You should have details of the gross foreign income, the country involved, the foreign tax paid and supporting evidence available when completing your return.

The treatment can vary if a treaty requires you to claim relief from the foreign tax authority instead. In some situations, relief needs to be obtained from the foreign tax authority before foreign tax is charged, while foreign tax already paid can generally be considered when reporting the income in the UK.

Double Taxation Relief Under the UK’s New Foreign Income and Gains Regime

The UK’s foreign income rules changed on 6 April 2025 when the remittance basis was replaced by the Foreign Income and Gains (FIG) regime. Under the current system, UK residents are generally taxed on the arising basis on their worldwide income and gains, while qualifying new residents may claim FIG relief on eligible foreign income and gains during their first four years of UK residence.

Who Can Claim the FIG Regime?

The regime is aimed at qualifying new UK residents who meet the required residence history.

You must be UK tax resident under the Statutory Residence Test.

You must be within your first four years of UK tax residence following at least 10 consecutive tax years of non-UK residence.

The relevant foreign income or gains must fall within the qualifying categories.
<li in several different ways, and the right approach depends on the circumstances.

Working for an overseas employer: Check your UK residence, where your employment duties were performed and the employment provisions of the relevant treaty.

Receiving overseas rental income: Rental income from property abroad may need to be reported in the UK even when tax has already been paid overseas.

Receiving foreign dividends: Check both the foreign withholding tax and the relevant UK treatment before calculating any credit.

Receiving overseas interest: Foreign savings interest can be taxable in the UK, with relief potentially available for qualifying foreign tax.

Receiving a foreign pension: Pension income can have specific treaty style="font-weight: 400">The foreign tax may be higher than the UK tax attributable to the same income.

The relevant treaty may restrict the amount of relief available.

The foreign tax may not qualify for UK credit.

The treaty may require you to claim relief from the foreign country instead.

The income may not be taxable in both countries in the same way.

<span style="font-weight: Relief

Keeping clear records can make the reporting process much easier, particularly when foreign tax has already been deducted.

<li tax on the same overseas income in two countries can be confusing, particularly when you are already dealing with different tax rules, reporting dates and exchange rates. Term Meaning Double taxation relief General term for relief that prevents or reduces tax being charged twice Foreign tax credit Credit for qualifying foreign tax against UK tax on the same income Tax treaty Agreement between two countries that sets out taxing rights and relief Foreign income Income arising outside the UK, such as overseas rent, interest or dividends Self Assessment UK tax return system used to report many types of foreign income Do UK Residents Pay Tax on Overseas Income? UK residents will normally need to pay UK tax on their foreign income and gains, although specific reliefs and exemptions can change the result. Foreign income can include overseas employment income, dividends, savings interest, pension income and rental income from property outside the UK. If foreign income is taxable in the UK and tax has also been paid overseas, you may be able to claim relief rather than paying tax twice on the same amount. Why Your UK Tax Residence Matters Your UK tax residence is one of the first things to check. How Double Taxation Relief Works in the UK The process can be easier to understand when broken down into six stages. 1. Identify the Overseas Income Start by establishing exactly what income you received and where it arose. This could be overseas employment income, rental income, interest, dividends, pension income or another type of foreign income. 2. Check Your UK Tax Residence Your residence status affects how your overseas income is treated in the UK. A person who is UK resident will normally have UK tax obligations on foreign income, subject to applicable reliefs. 3. Check the Relevant Tax Treaty Look at the UK’s tax treaty with the country where the income arose. The treaty may determine which country has taxing rights or limit the amount of tax that can be charged. 4. Confirm the Foreign Tax Paid Keep evidence showing the amount and type of foreign tax paid. Depending on the income, this may include a foreign tax statement, withholding certificate, tax assessment or other official record. 5. Calculate the Available Relief The credit is not automatically equal to the full amount of foreign tax paid. It is generally restricted to the UK tax attributable to the same income or gain. 6. Report the Income Correctly If the income needs to be reported through Self Assessment, include the overseas income and the relevant foreign tax details. The foreign pages of the return are used to record many types of foreign income and gains and claim applicable relief. How Foreign Tax Credit Relief Is Calculated A foreign tax credit can reduce the UK tax due on income that has already been subject to qualifying foreign tax. However, the credit is normally restricted to the lower of the qualifying foreign tax and the UK tax attributable to the same income. Example 1: Foreign Tax Is Lower Than UK Tax Suppose you receive £10,000 of overseas income and pay £1,500 of qualifying foreign tax. If the UK tax attributable to that same income is £2,000, a simplified calculation could result in a £1,500 credit. The remaining UK tax on that income would therefore be £500. Example 2: Foreign Tax Is Higher Than UK Tax Now suppose the same £10,000 of income resulted in £3,000 of qualifying foreign tax, while the UK tax attributable to that income was £2,000.
